Terms and conditions

The website www.rdndata.ro, hereinafter rdndata.ro, is the property of RDN Network Data SRL, registered in Prahova, J29/2972/2018, CUI/CIF: 40330970, hereinafter RDN Network Data SRL.

Using this website implies acceptance of the terms and conditions below as well as the privacy conditions. If the user does not agree with the terms and conditions of use, they must immediately stop using the services of www.rdndata.ro. We recommend reading them carefully. RDN Network Data SRL reserves the right to change these provisions without further notice. The most recent version can be found on this page, titled “Terms and conditions”.

RDN Network Data SRL grants the user limited access, for personal purposes (placing orders online, information), to the website www.rdndata.ro, and does not grant the right to download or modify the website in part or in full, to reproduce the website in part or in full, to copy, sell/resell or exploit the website in any other way, for commercial purposes or purposes contrary to the interests of RDN Network Data SRL, without its prior written consent.

The right to create a web link to www.rdndata.ro is limited, non-exclusive and revocable, and is granted as long as it causes no harm of any kind to RDN Network Data SRL or any of our partners, and only after obtaining our consent in writing or by email.

1. RDN Network Data SRL's copyright over the information published on the website:

The entire content of the website www.rdndata.ro – images, texts, graphics, symbols, web graphics, emails, scripts, programs and other data – is the property of RDN Network Data SRL and its suppliers and is protected by the Copyright Law (Law no. 8/1996) and by the laws on intellectual and industrial property. Using any element of the website's content without the company's consent is expressly prohibited, under penalty of criminal, civil or administrative liability. Users are prohibited from distributing, modifying, transmitting (including through automated copying programs) or using for public or commercial purposes any material on this website without the written consent of RDN Network Data SRL.

RDN Network Data SRL cannot be held responsible for any expense or damage suffered by a user/client through the breach of the terms and conditions listed above or of the legislation in force on copyright protection.

2. Products and services offered by RDN Network Data SRL on the website www.rdndata.ro, pricing policy

RDN Network Data SRL reserves the right to select its clients. Products/Services sold through www.rdndata.ro are accompanied by a tax invoice, in accordance with the legislation in force. Products and services are offered subject to the provisions of this document and within the limits of the contract.

During its operation, www.rdndata.ro will run special promotional offers, for which it will make available to clients the terms of the promotions, the promotion mechanism and its duration. www.rdndata.ro reserves the right to modify and/or interrupt any special offer unilaterally and without prior notice. www.rdndata.ro also reserves the right to unilaterally restrict access to any special offer for any client or user it suspects of trying to circumvent or improperly or abusively use the benefits of that offer.

RDN Network Data SRL offers no warranty, express or implied, regarding, including but not limited to, the operation of this website, the information, the accuracy of descriptions or the updating of content. Users expressly agree that using this website and purchasing the related products or services is at their own risk, the only exception being RDN Network Data SRL's obligation to grant users the right of unilateral withdrawal from the contract in accordance with the legislation in force, a right detailed further below in this document.

Art.1 – Hosting content policy

a. The client undertakes not to use the www.rdndata.ro servers and/or the web hosting service provided in any form and under any circumstances for hosting, communicating, referring to or directing to any of the following:

– nudity, pornography, any image or text with sexual or obscene content;

– violation of a copyright or any other right of any third party;

– threats, abuse, harassment, defamatory statements;

– illegal activities such as: phishing, spoofing, proxy, hacking, sniffing, identity theft, spreading computer viruses, keyloggers, trojans, warez (mp3, avi, music, films, programs/software without holding copyright and/or distribution rights), etc.;

– any image or text intended to encourage hatred; – collecting personal information for use for illegal purposes;

– websites with MLM (multi-level marketing) schemes

– pyramid schemes; – topsite or ranking systems, web directories, redirect sites (scripts); – IRC (mirc, mirc bots, etc), anonymizers, chat rooms not using the standard scripts in the control panel;

– file storage (e.g.: films, mp3 files, archives, personal photos, backup files, executable files (.exe, .bat, .dll) or other files unrelated to the client's website or not used within the website, etc);

– free email hosting, torrent, torrent tracker, free download and/or free upload, peer-to-peer hubs (DC++, etc); – audio/video streaming and/or any kind of real-time streaming such as online radio or television, any kind of online games, game servers (applies to shared, reseller and VPS hosting)

– any content that www.rdndata.ro considers harmful; otherwise, the web hosting service will be suspended or deleted without prior notice and without refund of the amount paid for hosting.

b. Any other scripts will be disabled or deleted without prior notice, and in serious or repeated cases the account will be cancelled, without refund of the amount paid for hosting.

c. The user declares that they understand and accept that in any situation in which the user claims damages of any kind from the provider, the total amount of damages claimed by the user for any reason that could be paid by the provider may in no way and in no case exceed the total amount of fees paid by the user to the provider.

d. www.rdndata.ro has no obligation to update the scripts used by clients. When a script is not updated, it can harm our servers and especially the other clients on that server. We reserve the right to block that website until the situation is fixed. The tools needed to clean viruses from your websites (Virus Scanner) are available in your account's control panel.

e. For your information, websites based on CMSs such as Joomla or WordPress, being open source, are the most vulnerable, so it is essential to keep their versions up to date.

Art.2 Backup

a. We make weekly backups of files, mailboxes and databases. However, we offer no guarantee of backup integrity. We advise all clients to download their own backups from the control panel, using the Backup option. Backups made by RDN Network Data are NOT GUARANTEED, except for accounts subscribed to a paid backup.

b. The client agrees to indemnify and hold RDN Network Data harmless from any claims or damages, including, without limitation, damages caused to third parties, arising as a consequence of the use of the services that cause damage to the client.

c. The provider is in no way responsible for the loss of hosted information as a result of users' actions or due to errors in applications not associated with the service. For example, the control panel is not associated with the service and is not provided by the provider, being developed and offered by cpanel.net or virtualmin.com

d. If an account is suspended and the client does not wish to renew the subscription, www.rdndata.ro will not provide access to the files in any form if the proforma invoice generated for the service is not paid. Each client's files are their property until the subscription expires; after the subscription expires, they become the property of RDN Network Data.

Art.3 Hosting .ro domains with annual payment

a. .ro domains with annual payment must be ordered together with a hosting plan, because they are leased and their nameservers cannot be changed.

Art.4 – Uptime guarantee

a. The service offered by www.rdndata.ro guarantees an average server uptime of 99.5%.

b. The following are exceptions:

– force majeure situations over which we have no influence, such as: wars, natural disasters, unavailability / interruption of communications, fire, viruses, hackers, malfunction of software provided by another source (free scripts, e-commerce software or online payment processors), floods, earthquakes, embargoes, actions of the legal authorities.

Art.5 – Account suspension for non-payment

a. Accounts of users who have not paid the service fees within 5 days of the provider issuing the proforma invoice will be suspended until payment is confirmed or until the date of payment, in accordance with the provisions above. Accounts can only be reactivated after payment is confirmed.

b. The provider may reopen accounts closed for non-payment only after full payment of all amounts owed by the user.

Art.6 – Resource usage

a. All accounts are monitored to track resource consumption on the server. If an account uses a very large amount of resources, we will contact the client to discuss it. If an account uses far too many resources (memory, processor), the account may be suspended or the script disabled without prior notice to the client, to keep the server running properly. Heavy resource users will not be accepted in any form on web hosting plans. www.rdndata.ro enforces the above by monitoring resource usage reports.

b. Clients may request a plan upgrade or a temporary increase of allocated resources. It is the client's responsibility to contact us in good time to request more resources and so avoid account suspension. In some cases accounts are suspended automatically when the allocated resource limit is reached, and reactivation requires manual intervention on our part.

3. Payment for services/products and payment methods:

Ordered Services/Products must be paid in full; otherwise delivery/execution will not take place. Products/services ordered on the website www.rdndata.ro under these “Terms and Conditions” can be paid in advance by Bank Transfer (Payment Order) or by Visa or MasterCard Credit/Debit Card through the MobilPay Netopia online payment processor.

Payment methods. Products on www.rdndata.ro can be paid for in 2 ways:

1. Bank transfer. Payment is made directly into the bank account of RDN Network Data SRL, opened at BRD, IBAN account: RO, CUI: 40330970, Trade Reg. No.: J29/2972/2018.
2. Online payment by Visa/MasterCard. The transaction is processed by a third-party company specialized in secure online payments. Payment by Visa/MasterCard debit/credit card is made through MobilPay Netopia.
   Your card details and the personal information needed for payment are not viewed or stored in any way by the website www.rdndata.ro

4. Delivery of Products / Services

Products/services can be delivered anywhere in the country or abroad. RDN Network Data SRL reserves the right to confirm orders before fulfilling them by contacting clients.

Services are delivered only electronically/by email or directly in the Beneficiary's platform.

Services are accepted after the electronic package is delivered or the service is set up on the client's website, within 7 business days. After this period, unless another acceptance period is stipulated in the contract, the service is considered delivered and in perfect working order.

RDN Network Data SRL reserves the right to delay or cancel deliveries/developments of ordered products/services if they cannot be fulfilled for reasons beyond RDN Network Data SRL's control, including: fires, explosions, floods, epidemics, strikes, government actions, wars, acts of terrorism, protests, uprisings, civil unrest or other force majeure impediments as defined by Romanian law.

The maximum amount of damages that RDN Network Data SRL may pay to any client in the event of non-delivery or improper delivery of the ordered service/product is the amount RDN Network Data SRL has received from that client.

The website www.rdndata.ro is hosted on our own servers. RDN Network Data SRL cannot be held responsible for any errors appearing on the website, whatever their cause, including changes to the website, settings or scheduled script updates. RDN Network Data cannot be held liable for errors caused by the use of certain browsers to visit the website www.rdndata.ro. RDN Network Data SRL is not responsible for the content, quality or nature of websites reached through links on the website www.rdndata.ro. Full responsibility for those websites lies with their owners.

5. Subscribing to and unsubscribing from the newsletter

Subscribing to and unsubscribing from the www.rdndata.ro newsletter is free and voluntary, and implies acceptance of the following terms of use. The messages sent are not unsolicited, and you can unsubscribe at any time by following the instructions at the bottom of each email. The messages sent comply with the Electronic Commerce law regarding commercial communication as stipulated by Romanian and international legislation.

The newsletter is used under the same limitation of liability regarding content as the use of the website, under the conditions set out in this document, and the privacy policy is described in detail in the following section. RDN Network Data SRL holds all rights to the content of the newsletter sent to subscribers under the same conditions as the information published on the website, in accordance with the provisions of this document. Subscribers to the www.rdndata.ro newsletter may forward these commercial communications to other people, on their own responsibility, provided they have not changed either the structure or the content of those messages. People who have received commercial messages from subscribers to the www.rdndata.ro newsletter are considered to have been informed in advance by the subscribers of the provisions of this article. In this context, RDN Network Data SRL cannot be held liable in any way for the actions of its subscribers.

RDN Network Data SRL reserves the right to restrict any subscriber's access to the newsletter if RDN Network Data SRL has any reason to believe that the subscriber does not comply with the provisions of this document.

6. Final provisions

Any other issue caused by the products and services presented on www.rdndata.ro that is not already covered by any article of this document will be settled amicably within 30 business days of the user notifying the issue in writing. If the dispute cannot be settled amicably, jurisdiction lies with the Romanian courts or with an alternative dispute resolution body agreed by both parties. By agreeing to these Terms and Conditions of use of the website www.rdndata.ro, the client fully assumes the consequences arising from using the website under these conditions.
